1. Introduction
These Terms of Service and Terms & Conditions (“Terms”) govern the provision of surveying services by Line Building Limited (“Company”, “we”, “us”, “our”) to the client (“Client”, “you”, “your”).
By instructing the Company to provide services, you agree to be bound by these Terms.

3. Definitions

Services means measured building surveys, topographical surveys, drone surveys, 3D laser scanning, photogrammetry, point cloud generation, CAD drawings, models, reports and related digital outputs.

Deliverables means all drawings, models, reports, imagery or digital data supplied by the Company.

Quotation means the written fee proposal issued by the Company.
4. Contract Formation
A legally binding contract is formed when:

A written quotation is accepted (email confirmation is sufficient),
-
A deposit is paid, or
-
The Client instructs the Company to proceed.
These Terms apply to all Services unless otherwise agreed in writing.
Quotations are valid for 30 days unless stated otherwise.
5. Scope of Services
The Company will provide Services strictly in accordance with:

The agreed Quotation
-
The defined scope of works
-
Any agreed written specification
Only items expressly stated are included.
Any additional work beyond the agreed scope will be chargeable.
If site conditions differ materially from those described, the Company reserves the right to revise the quotation.
6. Client Responsibilities
The Client must:

Provide accurate project and site information
-
Ensure safe, legal and unobstructed access
-
Obtain necessary permissions (including neighbour or landowner consent)
-
Inform the Company of known hazards
-
Ensure pets, occupants and children are managed during attendance
Delays caused by restricted access, inaccurate information or site conditions may result in additional charges.
7. Fees & Payment

Fees are set out in the agreed quotation.
-
Deposits may be required prior to attendance.
-
Final invoices are payable within 7 days unless otherwise agreed.

Deliverables may be withheld until payment is received in full.

Late payments may accrue statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.
8. Deliverables & File Formats
Deliverables may include:
-
2D CAD drawings
-
Floor plans, elevations, sections
-
Roof plans
-
3D models
-
Point cloud files (.e57, .rcp, etc.)
-
Orthomosaic imagery
-
Digital reports
File formats will be specified in the quotation.
The Company is not responsible for compatibility with software not specified prior to instruction.
9. Accuracy & Survey Limitations
The Company uses industry-standard equipment including laser scanners, GNSS systems and drone-based photogrammetry.
However:

Surveys are limited to visible and accessible areas.
-
Hidden structural elements cannot be guaranteed.
-
Furniture, finishes and obstructions may affect measurements.
-
Underground services are excluded unless specifically agreed.
Measured building surveys are for design and planning purposes only. They are not structural surveys.
Architects, engineers and contractors remain responsible for verifying dimensions prior to construction, fabrication or ordering materials.
10. Drone Operations
Drone operations are conducted in compliance with UK Civil Aviation Authority regulations.
Drone surveys are subject to:

Weather conditions
-
Airspace restrictions
-
Safety considerations
-
Site suitability
The Company reserves the right to postpone or cancel drone operations if conditions are unsafe or unlawful.
The Client warrants they have authority for aerial data capture over the property.
11. Reliance & Third Parties
Deliverables are prepared solely for the named Client and the stated project.
No third party may rely on Deliverables without prior written consent.
The Company accepts no liability for use of Deliverables:

On alternative projects
-
After alteration by third parties
-
Without full payment having been made
12. Intellectual Property
All intellectual property remains vested in Line Building Limited until full payment is received.
Upon payment, the Client is granted a non-exclusive licence to use Deliverables solely for the intended project.
Deliverables may not be resold, redistributed or reused for unrelated developments without written consent.
13. Insurance
The Company maintains:

Public Liability Insurance up to £2,000,000
-
Professional Indemnity Insurance up to £1,000,000
-
Employers’ Liability Insurance up to £10,000,000
Proof of insurance is available upon request.
14. Limitation of Liability
The Company shall perform Services with reasonable skill and care.
The Company’s total liability shall not exceed:

The fees paid for the relevant project, or
-
The applicable Professional Indemnity limit
(whichever is lower).
The Company shall not be liable for:
-
Indirect or consequential losses
-
Loss of profit
-
Construction errors
-
Costs resulting from failure to verify dimensions
-
Delays caused by weather or access restrictions
Nothing in these Terms excludes liability for death or personal injury caused by negligence.
15. Variations & Additional Work
If the Client requests changes after work has commenced:

Additional charges will apply
-
Delivery timelines may be extended
-
Revisions beyond agreed scope may incur fees
16. Cancellation
If the Client cancels:

Before site attendance: reasonable preparation costs may apply
-
After attendance: site visit and time costs are chargeable
-
Deposits are non-refundable once site work has commenced
Cancellations made less than 48 hours before a scheduled survey may incur charges.
17. Confidentiality & Marketing
The Company will treat project information as confidential.
The Company may use non-sensitive or anonymised imagery for marketing purposes unless the Client requests otherwise in writing prior to publication.
18. Data Protection
Personal data is processed in accordance with UK GDPR and the Company’s Privacy Policy.
19. Force Majeure
The Company shall not be liable for delays or failure to perform caused by events beyond reasonable control including:

Severe weather
-
Government or regulatory restrictions
-
Aviation restrictions
-
Equipment failure
-
Access limitations
20. Governing Law
These Terms are governed by the laws of England & Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.
